Terms of Use

These Terms of Use ("Terms") govern your use of the Never Away Android application ("the App"), provided by Trishunya Infotech ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. What the App does

Never Away lets your Android phone act as a Bluetooth Human Interface Device (keyboard and mouse) for a personal computer, using Android's built-in Bluetooth HID capability. No software is installed on the connected computer.

2. Licence to use

We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your personal or internal business use, subject to these Terms.

3. Acceptable use

You agree not to:

• Use the App to access, control, or interfere with a computer you do not own or do not have explicit permission to control.
• Use the App to circumvent, disable, or deceive workplace monitoring, security, or attendance systems in a way that violates your employer's policies or applicable law.
• Reverse-engineer, decompile, or attempt to extract the source code of the App, except where permitted by applicable law.
• Use the App in any way that is unlawful, or that infringes the rights of any third party.

4. Your responsibility for connected devices

You are solely responsible for the Bluetooth pairing you establish and for actions performed on the connected computer through the App, in the same way you would be responsible for actions performed with a physical keyboard and mouse.

5. Macros

Macros you record or import are executed exactly as authored. You are responsible for reviewing any macro - particularly one imported from another person - before playing it on a computer, since a macro can type text and press keys automatically.

6. Advertising and in-app offers

The App is free to use and supported by advertising provided through Google AdMob, including an optional rewarded-ad feature that temporarily removes ads. Ad content is served by Google and its partners; we do not control the specific ads shown. The App also includes the Meta SDK to measure which of our own ad campaigns lead to installs; how ads, analytics and install measurement handle data is described in the Privacy Policy.

7. Intellectual property

The App, including its design, code, and branding, is owned by Trishunya Infotech and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding beyond what is necessary to use the App normally.

8. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. Bluetooth behaviour can vary across phone and PC hardware, and we do not guarantee uninterrupted or error-free operation.

9. Limitation of liability

To the maximum extent permitted by law, Trishunya Infotech shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of data, arising from your use of, or inability to use, the App - including actions performed on a connected computer via a macro or manual input.

10. Changes to the App or these Terms

We may update the App or these Terms at any time. Continued use of the App after an update constitutes acceptance of the revised Terms. Material changes will be reflected by updating the "Last updated" date above.

11. Termination

You may stop using the App at any time by uninstalling it. We may suspend or discontinue the App, in whole or in part, at our discretion.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles.
